Rationale:

The power to impeach the president is an essential function given the considerable concentration of power the president holds as leader of the executive branch. The use of this power, however, should not be conflated with electoral politics or legislative conflict between the president and Congress.

Rather, impeachment should be a responsibility of the judicial branch, where legal, not political concerns are forefront. And impeachment is best handled by judicial experts who can base their judgement using their background and expertise in law and ethics.

In this new Constitution, the judicial branch is governed by a new body, the Judicial Congress, described later in the new Constitution. The establishment of the Judicial Congress provides for direct democratic involvement in the judicial system, while protecting it from the dramatic changes in public opinion sometimes evident in the legislative Congress.
